Terms of sale

Airpower Engineering Ltd, trading as Airpower Pneumatics and Custom Solutions (“Airpower”, “we”), Unit 12F, Six Cross Roads Business Park, Waterford, X91 TK28, Ireland. Registered in Ireland, company number 365388. VAT number IE6385388J. Phone 051 373 937 · sales@airpower.ie.

These terms govern orders placed on airpower.ie, by phone, by email or at the trade counter. Placing an order means you accept them.

1. Who is buying

Business customers (buying in the course of a trade, business or profession) and consumers have different rights in law. Sections marked “consumers” apply only to consumers, and nothing in these terms removes a right a consumer cannot give up.

2. Prices

All prices on airpower.ie are in euro and exclude VAT, which is added at checkout at the current Irish rate. Prices come from our stock system and can change without notice; the price when you place your order is the price you pay. If a listed price is plainly wrong, we will contact you before charging anything and you may cancel at no cost.

3. Ordering online

  • PayPal (and card, where offered) — payment is taken at checkout. Your order is an offer; our despatch confirmation is our acceptance.
  • Trade account order — no payment is taken online. The order goes to our sales desk, we confirm price and stock against your account, and nothing is charged until we confirm. A first order opens an account application; account facilities are at our discretion and subject to our credit application.

Lines marked “Enquire” are quoted individually and are not sold at a listed price. Lines routed to a partner’s own site (for example schmalz.com) are sold under that site’s terms.

4. Delivery

Online orders are delivered within the Republic of Ireland only. For Northern Ireland, exports or anything outside Ireland, contact the sales desk and we will quote freight individually.

Delivery costs €16.00 including VAT per order, or €60.00 including VAT when the order contains a heavy or freight-scale item such as pipe lengths or large vibrators. The checkout applies this automatically, and a mixed order is charged the heavy rate only.

In-stock lines ordered before our daily despatch cut-off are normally despatched for next-working-day delivery. Despatch times are our best estimate, not a guaranteed delivery date. Risk passes to you on delivery; ownership passes when we have been paid in full.

5. Cancelling and returns — consumers

If you are a consumer buying online, the European Union (Consumer Information, Cancellation and Other Rights) Regulations 2013 give you 14 days from receiving the goods to cancel, without giving a reason. Tell us in writing (email is fine) within that period, return the goods within 14 days of telling us, and we will refund the price and standard delivery within 14 days of getting them back. You pay the cost of returning them unless they are faulty. This right does not cover goods made to your specification or customised, or goods installed or used beyond what is needed to inspect them.

6. Returns — business customers

Business returns are accepted at our discretion. Contact the sales desk before sending anything back; goods must be unused and in their original packaging, and a restocking charge may apply. Specially ordered or custom items cannot be returned unless faulty.

7. Faulty goods and warranty

Consumers have their statutory rights to a repair, replacement or refund for faulty goods under the Consumer Rights Act 2022, and nothing here limits them. Manufacturers’ warranties apply as published for each brand. For business customers, our liability for defective goods is limited to repair, replacement or a refund of the price, at our option, and we do not accept liability for consequential loss, lost production or lost profit, to the fullest extent the law allows.

8. Technical advice

Sizing and application advice is given in good faith from the information you provide. Unless we have agreed a specification with you in writing, responsibility for a product’s suitability in your system rests with you.

9. Trade account payment

Account invoices are payable on the terms agreed when your account is opened. Overdue sums may carry interest at the rate set by the European Communities (Late Payment in Commercial Transactions) Regulations 2012, and we may suspend supply on overdue accounts.

10. General

These terms are governed by Irish law and the Irish courts have jurisdiction. If any clause is found unenforceable, the rest still apply.
